Acceptable Use Policy (AUP)
Acceptable Use Policy ("AUP"). This AUP describes prohibited uses of the services, network, and websites provided by Prez Communications, LLC and its affiliates ("Prez Hosting"). By using the Service, you agree to the latest version of this AUP. We may modify this AUP at any time by posting a revised version on the Prezcomm website; the revised version is effective upon posting. This AUP is incorporated by reference into your agreement with Prezcomm (the "Agreement").
1) Definitions
- Customer, you, or your
- The person or entity using the Service.
- System
- Any network, computer, device, application, account, or resource (including those of third parties).
- Content
- Any data, code, files, or material transmitted, stored, displayed, distributed, or otherwise processed via the Service.
2) No Illegal, Harmful, or Offensive Use or Content
You may not use (or encourage, promote, facilitate, or instruct others to use) the Service for any illegal, harmful, fraudulent, or offensive purpose, or to transmit, store, display, distribute, or make available Content that is illegal, harmful, or offensive. Prohibited activities include, without limitation:
- Illegal activities (any violation of applicable law), including dissemination or exploitation of child sexual abuse material (CSAM) or any material that exploits or endangers minors.
- Harmful or fraudulent activities, such as phishing, pharming, deceptive schemes, or distribution of stolen data/credentials.
- Infringement or misappropriation of intellectual‑property or proprietary rights.
- Offensive/abusive content, including defamation; non‑consensual intimate imagery; bestiality; or depiction of non‑consensual acts.
- Violent or terror‑related content that incites, threatens, or glorifies violence; creates a material risk to public safety or national security; or interferes with law‑enforcement investigations.
- Malicious code/operations, including viruses, worms, Trojans, backdoors, bots, or any technology intended to damage, intercept, or exfiltrate data or to gain unauthorized control of Systems.
- Unfair or deceptive practices under consumer‑protection laws.
3) No Security Violations
You may not use the Service to violate the security or integrity of any System. Prohibited activities include:
- Unauthorized access (probing, scanning, or testing a System; bypassing security or authentication; credential stuffing; brute force).
- Interception (monitoring traffic or data without authorization).
- Falsification of origin (e.g., forging TCP/IP or email headers). Lawful use of aliases is permitted, but not misrepresentation.
4) No Network Abuse
You may not make network connections to any users, hosts, or networks without permission as described here. Prohibited activities include:
- Monitoring or crawling that impairs or disrupts the target.
- Denial‑of‑Service (DoS/DDoS) or traffic floods; mail/news/broadcast bombing; or any activity that degrades a System.
- Intentional interference with proper functioning of any System.
- Operation of certain network services that impose security risk or abuse (e.g., open proxies, open mail relays, open recursive DNS) without our prior approval and controls.
- Circumventing use restrictions (quota limits, rate limits, access or storage controls).
- Withholding identity by falsifying contact/registration data or misreporting transmission/identification information.
- Spoofing/route abuse (e.g., BGP announcements without authorization, ARP or DHCP spoofing).
- Retaliation or actions likely to trigger attacks against the Prezcomm network, sites, employees, or agents.
5) Email & Messaging (Anti‑Spam)
You will not distribute, publish, send, or facilitate the sending of unsolicited bulk or commercial messages (“spam”). You may not alter/obscure headers or impersonate a sender without permission. You may not collect replies that would violate this AUP or another provider’s AUP.
If you send bulk or commercial email, you must:
- Comply with applicable laws (e.g., CAN‑SPAM, CASL, GDPR/PECR where applicable).
- Maintain and display a privacy policy for each sending domain and a conspicuous abuse contact and respond promptly.
- Use valid technical controls: accurate domain WHOIS, functioning rDNS, and properly configured SPF, DKIM, and DMARC.
- Send only to verifiable opt‑in recipients and retain proof of consent; provide such proof within 72 hours upon request by a recipient or Prezcomm.
- Include a working opt‑out/unsubscribe mechanism honored within 10 business days (or sooner if law requires).
- Maintain list hygiene (bounce processing, complaint handling) and avoid address harvesting or third‑party lists without auditable consent.
Blocklists: Any action that results in our IP space or your IPs/domains being listed on reputable abuse databases (e.g., Spamhaus) is a violation. We may suspend or rate‑limit outbound mail or require remediation until delisted.
6) Intellectual Property & Confidentiality
Do not use the Service to infringe or misappropriate IP or proprietary rights. Examples include: unauthorized copying/distribution of copyrighted works; publishing content intended to circumvent technical protection measures; displaying another’s trademark without permission; or disclosing another’s trade secrets or confidential information. Prezcomm may terminate repeat infringers’ Services in appropriate circumstances and without refund (see our DMCA policy for takedown/counter‑notice procedures).
7) Excessive Use of Shared Resources
On shared platforms, you may not use the Service in a way that unnecessarily interferes with other customers or consumes a disproportionate share of resources (CPU, RAM, disk I/O, bandwidth, inode counts, API calls). We may throttle, quarantine, or require you to remediate code or configuration issues. We may quarantine or delete clearly infected/corrupted data posing a risk to the platform.
8) Third‑Party Conduct & Security
You are responsible for violations of this AUP by anyone using your Service (including unauthorized users if due to your failure to employ reasonable security). Use reasonable measures—patching, firewalls, malware protection, access controls—to secure devices, applications, and credentials. Our enforcement rights apply even if a breach is unintentional or caused by malware.
9) Operational & Registry Matters
- Maintain accurate, current domain registration data for any domain hosted on the Prezcomm network.
- Use only IP addresses assigned by Prezcomm with your Service; do not advertise or route IP space without authorization.
- For zones hosted on Prezcomm‑managed DNS, if you are not the registrant or admin contact of record, we may modify, transfer, or delete such DNS records upon a verified request from the registrant/admin contact.
- Do not register or use the Service under a false identity or with an invalid/unauthorized payment method.
10) Monitoring, Reporting & Enforcement
We reserve the right (but do not assume the obligation) to investigate any suspected violation of this AUP or misuse of the Service or Prezcomm sites. We may:
- Remove, disable access to, or modify any Content or resource that violates this AUP or the Agreement.
- Suspend, rate‑limit, or terminate the Service, in whole or in part, with or without notice, based on risk and impact.
- Report suspected illegal activity to law enforcement or regulators and cooperate by providing appropriate customer/network information.
- Preserve logs and evidence as we deem appropriate and as required by law.
Appeals / Restoration. If your Service is suspended, you may request reinstatement after completing remediation steps we specify (e.g., patching, credential resets, blocklist delisting, proof of consent). Repeated or severe violations may result in termination.
SLA credit. No service credits apply for interruptions caused by AUP violations.
11) Export Controls & High‑Risk Use
You must comply with applicable export, re‑export, and sanctions laws. The Service is not designed for high‑risk activities where failure could lead to death, personal injury, or severe environmental damage (e.g., life‑support, air traffic control). You assume all risk for such use.
12) Reporting Violations
If you become aware of a violation of this AUP, promptly notify us at abuse@prezcomm.com and provide sufficient detail for us to investigate (e.g., logs, timestamps with timezone, source/destination IPs/URLs).
