Our Terms of Service

These Terms of Service ("Terms") govern your use of the products and services provided by Prezcomm Hosting ("Prezcomm", "we", "us", or "our"), including but not limited to VPS hosting, dedicated servers, colocation, shared web hosting, domain services, and related network and support services (collectively, the "Services").

By creating an account, placing an order, or using any of our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

1. Eligibility & Account Registration

  1. Eligibility. You must be at least 18 years old and able to enter into a binding contract to use the Services.
  2. Account Information. You agree to provide accurate, current, and complete information when creating your account and to keep this information updated.
  3. Account Security. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access or suspected compromise.

2. Description of Services

Prezcomm provides a variety of infrastructure and hosting services, including:

  • Virtual Private Servers (VPS)
  • Dedicated servers
  • Colocation (customer-owned hardware)
  • Web hosting and related services
  • Domain name registration and DNS
  • Support and professional services as applicable

Specific features, resource allocations, and service levels are defined on our website, in your order, and/or in your service description within the customer portal.

We may update Services, Pricing and features from time to time.

3. Acceptable Use Policy

You agree to use the Services only for lawful purposes and in compliance with these Terms and any applicable Acceptable Use Policy ("AUP") published by Prezcomm. The following activities are strictly prohibited:

  • Sending unsolicited bulk email (spam) or participating in spam-related activities
  • Hosting, distributing, or linking to malware, viruses, or malicious code
  • Hosting or distributing content that is illegal, abusive, defamatory, infringing, or that violates the rights of others
  • Participating in or facilitating denial-of-service (DoS/DDoS) attacks
  • Attempting unauthorized access to networks, systems, or data
  • Running open relays, open proxies, or misconfigured services that can be abused or misused
  • Using the network in a way that interferes with the normal operation or use of the network by others


We reserve the right to suspend or terminate Services for violations of the AUP or these Terms, with or without notice, in our sole discretion.

4. Customer Responsibilities

  1. Content & Data. You are solely responsible for all content, data, software, and activities conducted on or through your Services.
  2. Security. You are responsible for securing your systems, including applying updates, configuring firewalls, and maintaining strong passwords and credentials.
  3. Backups. Unless explicitly stated otherwise in your plan, you are responsible for backing up your data. Any backup features we provide are offered on a best-effort basis and do not replace your own backup strategy.
  4. Compliance. You are responsible for ensuring that your use of the Services complies with all applicable laws and regulations.

5. Resource & Network Usage

  1. Fair Use. You agree not to use excessive CPU, memory, bandwidth, disk I/O, or other resources in a manner that negatively impacts other customers or the stability of our infrastructure.
  2. Bandwidth & Transfer. Your plan may include specific bandwidth or data transfer limits. Overages may be billed at the then-current published rates or may result in throttling or suspension.
  3. Network Policies. We may implement rate limiting, traffic filtering, anti-abuse mechanisms, and other measures to protect our network and customers.

6. Colocation Services

If you use colocation services (hosting your own hardware in our facilities), the following additional terms apply:

  1. Customer Equipment. You retain ownership of your equipment. You are responsible for ensuring that your hardware is compliant with our facility requirements and is properly labeled and configured.
  2. Remote Hands. Remote hands services (as specified on your order) will require advance scheduling. Please submit a ticket for this service or for any questions for possible added costs.
  3. Network Transport. Speeds, IPs and Power are specified on your order. Excess usage may result in additional charges or require a service upgrade.
  4. Insurance. You are responsible for insuring your equipment. Prezcomm is not responsible for loss, theft, or damage to customer-owned gear except as required by law.
  5. Shipping. Shipping to our data center and from our data center on service cancellation requires the appropriate pre-paid shipping label (FedEx or UPS) and for the value of the item(s).
  6. Racking/De-Racking Fees. There are no fees for racking, there is a $50 one time fee for de-racking your equipment.

7. Dedicated Servers & VPS

  1. Access & Control. Depending on your plan, you may receive administrative/root access. You are responsible for how that access is used.
  2. Managed vs. Unmanaged. Unless explicitly labeled as "Managed", Services are provided on an unmanaged basis. Our support obligations are limited to the underlying hardware, network, and virtualization platform.

8. Payment, Billing & Taxes

  1. Billing Cycle. Services are typically billed in advance on a monthly or other agreed billing cycle. Your specific billing terms will be shown at checkout and in your portal.
  2. Payment Methods. You authorize Prezcomm or our payment processors to charge your selected payment method for all fees incurred.
  3. Late Payments. Failure to pay invoices by the due date may result in suspension or termination of Services. We may charge late fees where permitted by law.
  4. Chargebacks. Initiating a chargeback without first contacting us to resolve a billing issue may be considered a violation of these Terms and can result in suspension or termination.
  5. Taxes. Fees do not include applicable taxes unless stated. You are responsible for any sales, use, or similar taxes that may apply.

9. Term, Suspension & Termination

  1. Term. These Terms apply for as long as you have an active account or are using any Services.
  2. Customer Cancellation. You may cancel Services via the customer portal or by contacting us using an approved method. Certain services may have minimum terms or cancellation conditions.
  3. Suspension. We may suspend Services for non-payment, suspected abuse, security incidents, or violation of these Terms or our AUP.
  4. Termination. We may terminate Services, with or without cause, by providing notice as required by law or your specific service agreement. Upon termination, your data may be deleted and may not be recoverable.

10. Service Level & Maintenance

  1. Uptime Goals. We strive to provide high availability, but no specific uptime is guaranteed unless expressly stated in a separate Service Level Agreement (SLA).
  2. Maintenance. We may perform scheduled or emergency maintenance on our infrastructure. We will make reasonable efforts to minimize impact and provide notice where practical.

11. Privacy & Data Protection

Our collection and use of personal information is described in our Privacy Policy, which is incorporated by reference into these Terms. By using the Services, you consent to the collection and use of information as described in the Privacy Policy.

12. Disclaimers & Limitation of Liability

  1. As-Is Basis. Except where prohibited by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory.
  2. No Guarantee of Results. We do not guarantee that the Services will be uninterrupted, error-free, or completely secure.
  3. Limitation of Liability. To the maximum extent permitted by law, Prezcomm shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising out of or relating to the Services or these Terms.
  4. Cap on Direct Damages. To the extent allowed by law, our total cumulative liability for direct damages will not exceed the amount you paid to Prezcomm for the Services during the two (2) months immediately preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Prezcomm, its owners, employees, and contractors from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your content, or your violation of these Terms or any applicable law.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version on our website and update the "Last updated" date above. Continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.

15. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

Any disputes arising out of or relating to these Terms or the Services shall be resolved in the state or federal courts located in or serving Collin County, Texas, and you consent to the personal jurisdiction of such courts.
